Fox Business News produced a segment on a recent patent case that could limit entrepreneurs’ ability to protect their ideas.
Finnegan partner Michael Jakes was interviewed on the show about his work for Bernard Bilski and Rand Warsaw in Bilski v. Kappos, currently pending in the U.S. Supreme Court. During the interview, Jakes said his clients came up with a great idea and applied for a patent in 1997, “but the Court of Appeals said it’s not the right kind of invention—it’s not tied to a machine, nor does it transform particular subject matter.
That’s the issue we took to the Court last week.” Jakes closed the interview by reiterating the patent application’s relevance to real-world situations: “Just look at the patent as a practical application. [Bilski and Warsaw] have a real-world method that they’re actually using in their business. And it’s very useful. It’s not what we would call an abstract idea…There’s no reason it shouldn’t be at least eligible to be considered for a patent.” The video of the interview may be viewed online . "
